The purpose of this privacy statement (“Privacy Statement”) is to inform you about our privacy practices, including how we collect, use and disclose your Personal Information.

This Privacy Statement applies to the collection, use and disclosure of Personal Information through our website (www.ourpwr.co) or any of our related websites, any of the related services we provide, and through our interactions with customers and potential customers (collectively, our “website”) and the related content, platform, services, products, and other functionality offered on or through our mobile application (“app”) (collectively, our “products or services”). This Privacy Statement applies to all of our operations in Canada or operations in connection with Canada, unless we have provided you with a separate privacy statement for a particular product, service or activity.

We may make changes to this Privacy Statement from time to time, which will become immediately effective when published in a revised Privacy Statement posted on our website unless otherwise noted. Meaning of Personal Information

"Personal Information" means information about an identifiable individual as described under Canadian privacy laws, which may include, but is not limited to, your name, e-mail address and telephone number. Personal Information does not include any business contact information that is solely used to communicate with you in relation to your employment, business or profession, such as your name, position name or title, work address, work telephone number, or work e-mail address. Personal Information also does not include information that has been anonymized or aggregated in such a way that there is no serious possibility it can be used to identify an individual, whether on its own or in combination with other information.

How We Collect Your Personal Information

Directly from you: When you inquire about or use our website or products or services, when you contact us by phone, email, or other means, when you register, subscribe to, or purchase our products or services or when you conduct real name-authentication, make online purchases through our app or our website, create an account, update your profile settings or bio, provide feedback about dangerous situations and emergency response effectiveness, share your opinions about our app functionality, or activate evidence capture features, we will collect the Personal Information you provide us. Evidence capture access to your camera and microphone is granted during profile setup and can be activated by you or automatically by the application in specific user-defined situations through the action button, lock screen, or in-app controls.

Automatically: We automatically collect location information while the application is running in the foreground or background, with your permission, as this directly affects app functionality and your safety. We will also automatically collect information related to you through cookies and similar technologies when you visit our website, when you download content from us, when you open emails we send or click on links in the emails, and when you interact or communicate with us.

From Third Parties: When you make payments to us through third-party payment processors (such as app stores or website payment providers), when applicable laws require a third party to share your Personal Information with us, or when you authorize a third party to share your Personal Information with us, we will collect your Personal Information from that third party.

Your Consent to Collection, Use and Disclosure

We collect, use and disclose your Personal Information with your consent or as permitted or required by Canadian privacy laws. How we obtain your consent may be express or implied and will depend on the circumstances, as well as the sensitivity of the information collected. If you choose to provide Personal Information to us, we assume that you consent to the collection, use and disclosure of that Personal Information as outlined in this Privacy Statement. We obtain explicit consent from you when you click “I agree” at the time consent is requested.

If you wish to withdraw your consent to our collection, use or disclosure of your Personal Information, please contact us using the contact information in the “How to Contact Us” section below. In some cases, withdrawal of your consent may mean that we will no longer be able to provide certain products or services. You may also withdraw your consent for certain features that collect Personal Information through toggling the settings within the app on your device.

Personal Information We Collect

This Privacy Statement applies to Personal Information from website visitors, customers, and third-party vendors. We collect only the minimum Personal Information necessary to provide, maintain, and secure our products or services, and we avoid collecting information that is not needed for those purposes. We collect Personal Information directly from you (i.e. directly through your input of Personal Information into our product and website, through account registration forms, contact us forms, career application forms, surveys and feedback forms, or orally through in person meetings), automatically from your device or browser when you use our website or products or services, and from service providers and partners that assist us in providing, securing, and improving our services.

Products and Services

We may collect:

  • technical, behavioural and usage data that is identifiable to you when you use our technology applications.
  • identity information, such as your name and gender, and verification that you are age of majority;
  • contact information, such as your e-mail address and telephone number;
  • health information (optional), such as any serious medical issues you choose to share with us;
  • physical descriptors (optional), such as hair colour, hair length, skin tone, eye colour, and any birthmarks or tattoos;
  • province or state information, location information (GPS data), time information, and information collected through camera, microphone, and audio features when you use our evidence capture functionality, in each of these cases where you have granted us permission or access through the device to use such features and functionality;
  • if you choose to enable push notifications on the device used to access our products and services, we may use your information, such as device ID or email address, to send push notifications including feature updates and emergency alerts when users nearby need assistance;
  • profile information (optional), including a profile photo, bio with information you choose to share with other users (such as interests or location), and photos of what you are wearing which remain private in your account for safety purposes;
  • education information, such as whether you are a current student (for discounted rates) and the school you attend (optional), and community group affiliations such as sororities, fraternities, or other organizations (optional), which may be used to enable you to join specific community response groups;
  • employment or safety experience (optional), such as whether you are a first responder or have a background in martial arts or other relevant experience to support other users;
  • evidence capture information, including video recordings, audio recordings, time information, and detailed location data when you use our evidence capture functionality, which you control and can delete at any time;
  • event participation information, such as your enrollment and attendance at our events;
  • feedback and survey information, including app functionality feedback, suggestions for improvements, and optional follow-up questionnaires after you have been involved in or responded to a distressing situation;
  • payment information, which includes payment type (including credit card or gift cards) and user ID for app store subscriptions (Apple App Store and Google Play Store). For website purchases, billing address, cardholder name, card number, and email address are collected by our third-party payment processor. If purchasing as a gift, the email address of the intended recipient is also collected.

Website.

  • For individuals who visit our website, we may collect information from you or from your activities on the site. For general use of our website and products or services, we do not require you to provide your name, email address, or other contact information unless you proactively submit it (for example, by completing a contact form or subscribing to email updates).
  • Like most websites and other Internet services, we may collect certain technical and device information about your use of our website. A "cookie" is a small text file that contains information and is stored on your computer. We use cookies and similar tracking technologies, such as web beacons and pixels, to automatically collect information about your use of our website and your interaction with our emails. Information we collect may include your Internet protocol address (or proxy server), device and application identification numbers, information about your device, browser and operating system, the region or general location where your device is accessing the internet, internet service provider and/or mobile carrier, pages and files viewed, searches, system configuration information, date/time stamps associated with your usage, and a history of the pages you view. We also collect information about your interactions with our website and app, including duration on different pages, behavioural trends, button and link clicks, common searches, login and active status, website preferences and language selection, whether you are a new or returning visitor, load times, technical issues, user drop-off points, and A/B testing results for price and functionality testing. For website visitors, we may collect ad interaction data. You can manage or opt out of cookies and similar tracking by adjusting your browser and device settings or using privacy-focused browsers or extensions.

How we use your Personal Information

We may use your Personal Information for purposes such as:

  • providing you with our personal safety products and services, connecting you with nearby users who can assist in emergencies, providing location-specific safety resources and crime statistics, and supporting your use of our evidence capture and emergency alert features;
  • handling financial transactions necessary to provide the products or services, such as collecting payment through third-party payment processors (app stores and website payment providers) and processing refunds;
  • contacting you relating to our products or services;
  • monitoring the usage of our products or services to support their proper functioning and further improvement;
  • helping to maintain the safety, security and integrity of our products or services;
  • analyzing the needs and activities of our users to help us better serve them, improve safety outcomes, and optimize our user network and emergency response features;
  • generating de-identified data to conduct research and analysis related to our business, products or services;
  • responding to inquiries and other requests;
  • collecting opinions, feedback, and suggestions about our products and services, including follow-up information about the effectiveness of emergency assistance provided through our platform;
  • developing marketing materials;
  • determining your eligibility for our services in accordance with applicable laws and our policies;
  • detecting and preventing errors and fraud and investigating legal claims; and
  • for such other purposes as you may otherwise consent from time to time.

We may use your Personal Information for purposes for which we have obtained your consent, and for such other purposes as may be permitted or required by applicable Canadian privacy laws. We will collect, use, and disclose information received through our website only to pursue our legitimate business interests in keeping you updated on our services and products, respond to your queries, establish communication with you and your company, and to enhance user experience by analyzing your use of our website.

How We Share Your Personal Information

When you use our emergency assistance features or choose to share information with your network, certain information may be shared with other users of our platform. This may include your name, profile information you have chosen to make public (such as your bio, student status, or safety experience), and your location when you request emergency assistance or choose to share your location with your network. You control what profile information is visible to other users, and your exact location is only shared with other users when you request help or explicitly choose to share it. We rely on third-party service providers to perform a variety of services on our behalf, such as app store payment processors (Apple App Store and Google Play Store), website payment card processors (such as Squarespace, Shop, or similar providers), technical support providers, artificial intelligence and machine learning service providers, data storage and processing service providers (AWS in the USA), and research and analytics providers.

If we provide information to service providers, we require that the service providers keep your Personal Information secure and only handle it for limited purposes. We do not authorize the service providers to disclose your Personal Information to unauthorized parties or to use your Personal Information for their direct marketing purposes.

We may disclose your information in the event of any significant business transaction, such as a merger or reorganization. Additionally, we may use and disclose your information when we believe such use or disclosure is permitted, necessary or appropriate: (a) under applicable law, including laws outside your country of residence; (b) to comply with legal process; (c) to respond to requests from public and government authorities, including public and government authorities outside your country of residence; (d) to enforce the terms of the agreements for our products or services; (e) to protect our rights, operations or property; (f) to allow us to pursue available remedies or limit the damages that we may sustain.

If we otherwise intend to disclose your Personal Information to a third-party, we will identify that third-party and the purpose for the disclosure, and obtain your consent.

Opting Out of Communications

If you have signed up to receive emails from us and you no longer want to receive marketing-related emails from us, you may opt-out of receiving emails by clicking the “unsubscribe” link at the bottom of any email you receive from us. You may object at any time to, and opt-out of, our use of your personal data for direct marketing purposes by contacting us directly using the contact information in the “How to Contact Us” section below.

We will endeavour to respond to your opt-out request promptly, but we ask that you please allow us a reasonable time to process your request. Please note that if you opt-out from receiving marketing-related emails, we may still need to send you communications about your use of our products or services, or other matters.

Retention of Personal Information

We will use, disclose or retain your Personal Information only for as long as necessary to fulfill the purposes for which that Personal Information was collected and as permitted or required by Canadian privacy laws. Our current practice is to delete or anonymize Personal Information when the account associated with the information is deleted. You can contact us to request disposal of specific information when deactivating an account or when an active account is no longer needed. Personal data is disposed of according to our Personal Data Disposal policy, using logical deletion or cryptographic erasure depending on sensitivity.

If your Personal Information was collected in connection with your use of our products or services, upon request by you within ninety (90) days after the effective date of termination or expiration of the applicable term for such product or service, we will make any Personal Information related to those products or services for which such term has expired or been terminated, available to you. After such 90-day period, we will have no obligation to maintain, provide or make available such Personal Information, and we may thereafter delete, destroy, or anonymize all copies of the Personal Information in our systems or otherwise in its possession or control, unless legally prohibited from doing so. De‑identified information that could indirectly identify an individual continues to be treated as Personal Information.

International Transfer and Storage of Information

Your Personal Information may be stored and processed at our offices in Canada or at the offices of our third-party service providers, Amazon AWS in the USA. Other jurisdictions may have different data protection rules from Canada. While your Personal Information is outside of Canada, it is subject to the laws of the country in which it is located. Those laws may require disclosure of your Personal Information to authorities in that country. Before communicating Personal Information outside Quebec, we assess whether it would receive protection equivalent to that required by Quebec law and implement appropriate safeguards.

Information Security

We have implemented physical, organizational, contractual and technological security measures with a view to protecting your Personal Information and other information from loss or theft, unauthorized access, disclosure, copying, use or modification. We have taken steps to ensure that the only personnel who are granted access to your Personal Information are those with a business ‘need-to-know’ or whose duties reasonably require such information. Our security measures include:

  • Data Encryption at Rest: We leverage data encryption at rest provided by AWS services using 256-bit Advanced Encryption Standard Galois/Counter Mode (AES-GCM).
  • Physical and Perimeter Security: We leverage AWS physical and perimeter security measures as detailed at https://aws.amazon.com/trust-center/data-center.
  • Data in Transit Protection: We protect all data in transit using TLS 1.3 for all data-in-transit communications.
  • Secure Authentication: We use OAuth 2.0 for secure communication between the application and backend systems.
  • Data Retention and Disposal: We follow clear retention timelines and implement automated protocols for the secure disposal or anonymization of data that is no longer needed.
  • Access Controls: We follow the Principle of Least Privilege (PoLP), ensuring employees only have access to the specific data required for their job function.

Despite the measure outlined above, no method of information transmission or information storage is 100% secure or error-free, so we unfortunately cannot guarantee absolute security. We may also require that you assist us in safeguarding your personal information. For example, if you create an account through our website or application, you should use a unique and strong password and not share your password with others. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any information that you provided to us has been compromised), please contact us immediately using the contact information in the “How to Contact Us” section below.

Accessing and Updating Your Personal Information

We expect you, from time to time, to supply us with updates to your Personal Information, when required. We will not routinely update your Personal Information, unless such a process is necessary.

You may make a written request to review any Personal Information about you that we have collected, used or disclosed, and we will provide you with any such Personal Information to the extent required by applicable laws. You may also challenge the accuracy or completeness of your Personal Information in our records. If you successfully demonstrate that your Personal Information in our records is inaccurate or incomplete, we will amend the Personal Information as required.

We may require that you provide sufficient identification to fulfill your request to access or correct your Personal Information. Any such identifying information will be used only for this purpose.

Third-Party Websites and Services

This Privacy Policy also does not apply to any products, services, websites, or content that are offered by other third parties. When you provide personal information to us on a third-party website or platform, the personal information you provide may be separately collected by the third party and subject to the privacy statement of the third-party website or platform. We are not responsible for the privacy measures of such websites or platforms.

Minor’s Personal Information

Our products and services are not intended for minors under the legal age of majority, and we do not knowingly collect personal information from minors. Minors should not use our products and services and should not provide us with their personal information.
